A court in Graz has issued an 18-month prison sentence, with six months to be served without suspension, to the operator of the Stern Bar following a deadly fire that occurred during New Year's celebrations at the end of 2023. The incident resulted in the death of a university student and left ten others injured, some severely. The court determined that negligence related to fire safety regulations contributed to the tragic outcome.
During the trial, details emerged about the conditions in the establishment at the time of the fire. The prosecution argued that flammable materials were stored near the entrance, and emergency exits were either blocked or inadequately marked. Testimonies from survivors described the chaos and difficulty in finding a safe escape route as the fire spread in the early hours of New Year's Day.
Investigations revealed that officially, the bar had three designated escape routes: the main entrance, a window, and a path through the kitchen leading to the courtyard. However, at the time of the fire, the window was obstructed by a table and decorative items, making it inaccessible. The kitchen route was also criticized by safety experts as inappropriate, as kitchen areas pose additional hazards during emergencies.
Further scrutiny of regulatory compliance showed that after a 2020 inspection, several safety deficiencies were noted in the venue. Despite these findings, no follow-up action was taken by the authorities, with officials reportedly closing the case as a routine procedure. The absence of additional inspections or enforcement of corrections left existing hazards unaddressed.
Expert testimony during the trial highlighted that fire exits must be clearly marked and unobstructed at all times. The use of a sliding door in the kitchen, which did not open in the direction of escape, was also deemed non-compliant with safety requirements. In addition, storage of items such as cushions, blankets, and paper products near the main exit was identified as a violation of fire safety guidelines.
The bar operator maintained throughout the hearings that all regulations were followed and denied responsibility for the fatal outcome. However, the court found that the failure to ensure accessible escape routes and the improper storage of flammable materials constituted gross negligence. The verdict has not yet become final, and further legal proceedings are ongoing to determine whether municipal authorities shared responsibility for the inadequate safety measures and the consequences of the blaze.
The case continues to draw attention to fire safety standards and enforcement in public venues. It has prompted broader discussions about the roles of both business operators and local authorities in preventing similar tragedies and ensuring compliance with safety regulations.
