Murder Trial in Vienna: Defendant Abandons Self-Defense Claim in Fatal Neighbor Shooting

The trial of a 50-year-old man accused of fatally shooting his neighbor in a Vienna residential complex began with a significant development. The two men, who had lived adjacent to one another for several years, became involved in a physical confrontation at the defendant's doorstep.

During the altercation, the defendant, who was allegedly under the influence of alcohol and in possession of a legally owned revolver, drew the weapon from his waistband. The firearm discharged, striking the neighbor in the upper body. Forensic examination revealed the victim suffered a fatal injury to the abdominal aorta, leading to rapid blood loss and death at the scene.

The prosecution contends that the killing was intentional and potentially motivated by xenophobic or racist attitudes. It was highlighted that the accused, unemployed since 2023 and a licensed sports shooter, had previously exhibited hostility towards foreigners, a sentiment reportedly known among residents of the apartment complex. The prosecution further noted a prior incident in August, when the accused allegedly set fire to the victim's doormat.

Medical evidence presented in court indicated that the victim sustained notable injuries prior to the shooting, including fractures to the hyoid bone and thyroid cartilage, consistent with manual strangulation. The victim's nasal bone was also broken, suggesting a forceful blow to the face that caused him to fall to the floor. According to the prosecution, the defendant then fired the fatal shot as the victim attempted to stand up.

After the shooting, the accused contacted law enforcement, claiming that the victim had threatened him and attempted to force entry into his apartment, allegedly armed with a knife. However, the investigation did not uncover any weapon in the immediate vicinity. The prosecution maintains that these statements were attempts by the accused to justify his actions and that he used derogatory language towards the victim in the presence of police officers.
