A 15-year-old girl has been found guilty of committing sexual assaults against a 12-year-old boy while the two resided at the same youth care home in central Sweden. The incidents took place during the summer, when both individuals were placed at the facility for social care reasons.
According to court documents, the girl believed she and the boy were in a romantic relationship, although she acknowledged that their interactions may have been inappropriate. The boy, in contrast, stated that he had made it clear he did not consent and that the girl had initiated the acts without his willingness.
During the investigation, it was revealed that the girl has several neuropsychiatric diagnoses and demonstrates below-average cognitive abilities. Despite these factors, the district court determined that such diagnoses did not warrant a reduction in the seriousness of the offenses, referencing a previous Supreme Court decision emphasizing that the victim's age is the primary factor in such cases. In the earlier case, the Supreme Court held that sexual offenses against minors under 15 are considered especially grave, regardless of the perpetrator's mental health or age, provided they are over the age of criminal responsibility.
In this case, the court noted that the girl was aware of the boy's age at the time of the offenses. Had an adult committed similar crimes, the cumulative penalty would have amounted to approximately three years and nine months of imprisonment. However, due to the girl's age and her diagnosed conditions, the court imposed a lesser sentence of seven months of supervised youth care. The sentencing took into account both her age and her mental health diagnoses, as required by Swedish law for juvenile offenders.
The court also considered the fact that the girl voluntarily disclosed the events, which played a crucial role in the crimes being discovered and investigated. This cooperation resulted in a further reduction of her sentence, as her account was deemed vital to the resolution of the case.
In addition to the custodial sentence, the girl has been ordered to pay damages totaling 290,000 SEK to the victim. The boy had initially requested higher compensation, but the court settled on an amount reflecting the severity of the offenses and the psychological impact on the victim.
This case highlights the legal complexities involved when juveniles with psychological or developmental conditions are involved in serious criminal offenses. The court's decision balances the need for accountability with considerations for the perpetrator's age and mental health, while reinforcing the protection of minors against sexual exploitation within institutional care settings.
