A teacher in Dalarna has been acquitted of charges relating to hate speech following an incident during a music lesson in December. The individual, who was serving as a substitute teacher, reportedly made Nazi salutes and allegedly encouraged students to participate in similar gestures.
After the class, several students discussed the incident with their parents, prompting the school principal to take notice and subsequently terminate the teacher's employment.
In February, the teacher faced legal action for hate speech. However, the Falu District Court has now ruled in favor of the teacher. In its decision, the court acknowledged that the teacher admitted to performing Nazi salutes in front of the students, which could be interpreted as hate speech. Moreover, with approximately 20 students present, the legal criteria for public dissemination were met.
Nevertheless, the court emphasized that the teacher lacked the requisite intent for a conviction. The individual claimed that the actions were meant as a joke and expressed intentions to develop a performance that parodies Nazism, asserting that he had informed the students that it was satire.
The court noted that this claim received some validation from films the teacher had previously shown to the students. The principal stated that only adults had reacted negatively to the situation and did not believe the teacher harbored any racist views.
In its ruling, the court indicated that the investigation did not yield any testimonies from the students who were present during the lesson. This lack of student input meant that the assertion that they understood it as parody could not be confirmed or disputed.
The teacher acknowledged that it was imprudent to engage in such a provocative display in the presence of young individuals and outside of his subject area without prior notification to the principal. However, the court maintained that this did not equate to the presence of intent.
Consequently, the court dismissed the charges, leading to the teacher's acquittal.
For further updates, a school nurse has also been charged with sexual offenses against students, with legal proceedings currently underway.
