Lower Austria Files Lawsuit Against Vienna Over Guest Patient Dispute

In a recent escalation of the ongoing dispute regarding guest patient policies, the government of Lower Austria has initiated legal proceedings against the city of Vienna. The legal action was submitted to the Regional Civil Court in Vienna, following the refusal of a medical procedure to a patient residing in Lower Austria. This move follows previous indications by Lower Austrian officials that legal steps would be taken in response to recent policy changes affecting access to healthcare services for residents of neighboring federal states.

The case centers around a patient from the Mistelbach district who had been scheduled for surgery in a Vienna hospital after waiting for approximately 15 months. However, this operation was later canceled, and the patient was informed that the procedure could not be performed due to his official residence being registered in Lower Austria, rather than Vienna. The patient is now seeking compensation in excess of 15,000 euros, citing damages as a result of the canceled operation. He has since been rescheduled for surgery at the University Hospital Tulln.

Lower Austrian officials have emphasized that, under an agreement signed in 2023, guest patient arrangements between Austria's federal states should ensure seamless access to medical services, irrespective of the patient's place of residence within the country. According to their statement, all other states continue to adhere to the agreement without issue, while Vienna is claimed to have deviated from the established protocol. Lower Austria maintains that the key criterion should be the patient's medical needs, not their official registration or address.

The dispute has highlighted broader concerns regarding healthcare access for residents of different federal states, particularly in cases where individuals may live near state borders or require specialized treatment only available in certain regions. Lower Austria's leadership has reiterated its commitment to ensuring that residents receive fair and equal access to medical care, stating that ongoing dialogue with Vienna remains a priority in resolving the issue.
