An Austrian police officer has been found guilty by the Regional Court in Feldkirch for inflicting serious bodily harm during an official intervention. The court determined that the officer, aged 54 and with extensive years of service, had exceeded his authority during a domestic disturbance call in December 2023.
Authorities responded to a report of domestic violence at a residence in Feldkirch, where a woman had called for police assistance. Upon arrival, officers encountered her two sons, aged 29 and 31, at the entrance. The caller informed the officers that the situation had been resolved. However, one of the officers insisted on verifying the situation inside the home before concluding the call.
A disagreement quickly escalated when the younger son allegedly insulted the officer. The situation deteriorated further as the officer, losing composure, physically assaulted the older son with multiple blows to the head. In attempting to protect himself, the victim suffered a broken hand and sustained additional injuries including a head contusion and facial bruising. Medical reports confirmed that the injuries required two surgical procedures and resulted in more than six weeks of work absence for the victim.
Fellow officers present during the incident testified that, while the atmosphere was tense, there was no immediate threat to justify the level of force used. The court emphasized that the use of violence by the officer was not proportionate to the circumstances, nor was there any indication of imminent danger that would necessitate such action.
Following deliberation, the court imposed an eight-month suspended prison sentence on the officer and ordered a direct financial penalty. Additionally, the injured party was awarded partial compensation for pain and suffering. According to the court, the defendant did not express any acknowledgment of wrongdoing or remorse during the proceedings.
Both the convicted officer and the public prosecutor have submitted appeals against the decision. As a result, the judgment is not yet legally binding and remains subject to further judicial review. The case has prompted discussions regarding use of force protocols and accountability within law enforcement agencies in Austria.
