Amnesty International Austria has expressed support for the recent proposals within Austria's draft legislation aimed at combating Strategic Lawsuits Against Public Participation (SLAPPs). The human rights organization welcomed the initiative to implement protective measures for domestic legal proceedings, in addition to the requirements set by the European Union's directive.
SLAPP lawsuits are legal actions intended to intimidate critics, activists, and journalists by subjecting them to prolonged and costly court processes. Such lawsuits can deter individuals and organizations from participating in public discourse and expressing their opinions. The European Union has enacted a directive that establishes minimum standards for addressing these lawsuits, but the directive does not require member states to implement protections in domestic criminal or administrative proceedings.
The Austrian Justice Ministry's draft proposal seeks to address this gap by extending legal protections to those facing SLAPPs within Austria's own courts. This move aligns with recommendations from the Council of Europe, which has also urged member states to adopt safeguards in national legal systems to prevent the misuse of legal processes to stifle public debate.
Amnesty International Austria has emphasized the importance of adopting robust legal mechanisms that go beyond the EU's minimum requirements. The organization advocates for comprehensive guarantees that allow for the early dismissal of abusive lawsuits, thereby reducing the financial and psychological burden on those targeted. The draft legislation proposes that courts should be empowered to identify and dismiss SLAPP cases at an early stage, and that individuals subjected to such lawsuits should be able to recover legal costs from the party initiating the action.
According to data referenced by Amnesty, the majority of SLAPP cases--estimated at around 90%--occur within national jurisdiction. Without effective prohibition of abusive domestic lawsuits, the impact of anti-SLAPP measures would be significantly diminished. Therefore, the organization is calling for Austria to implement a legal framework that not only meets but exceeds European minimum standards, ensuring that protections are available in all relevant legal contexts, including criminal and administrative proceedings.
Further, Amnesty International Austria has called for additional measures to support those targeted by SLAPPs. This includes access to legal, financial, and psychological assistance throughout the legal process. Such support is seen as essential to safeguarding fundamental rights, including freedom of expression and the right to participate in public debates.
The draft legislation has drawn attention within Austria's political sphere, with advocacy groups urging lawmakers not to delay or weaken proposed reforms. The Justice Ministry's commitment to strengthening legal protections against SLAPPs has been viewed as a positive step, but stakeholders continue to press for even stronger and more comprehensive measures to ensure effective protection of civil society actors, journalists, and others engaged in matters of public interest.
The developments in Austria are part of a broader European effort to address the growing use of SLAPP lawsuits as a tool to undermine freedom of expression and intimidate dissent. As national governments work to implement the EU directive, the extent to which they choose to enhance protections at the domestic level will determine the effectiveness of the fight against abusive litigation practices.
