The redevelopment project at Vienna's Heumarkt has entered a new phase of legal scrutiny following a recent decision by the Federal Administrative Court. The court determined that the latest design proposal for the Heumarkt area requires a comprehensive environmental impact assessment. In response, Wertinvest, the company led by Michael Tojner and responsible for the development, has announced plans to file an extraordinary appeal with the Administrative Court.
The planned project involves the construction of residential units as well as the reconstruction of the Hotel Intercontinental in Vienna's city center. Over the years, the proposal has undergone several modifications. These changes were prompted by concerns from UNESCO, which cited potential adverse effects on Vienna's historic cityscape. Due to these concerns, Vienna's historic core was added to the Red List of World Heritage Sites. To address the feedback, the current proposal has been revised to include a building with a maximum height of 49.95 meters, lower than earlier versions.
Representatives for Wertinvest have stated that they believe the Austrian judicial system is relying on external organizations for assessment rather than basing decisions on national and European legislation. Despite this, the Vienna Municipal Department 22, which oversees environmental matters, has confirmed that the project developer is entitled to pursue an extraordinary appeal to the Administrative Court.
The ongoing controversy has drawn strong reactions from political parties in Vienna. Opposition groups have interpreted the court's ruling as validation of their longstanding concerns regarding the project's compatibility with the city's heritage. The Vienna People's Party, for example, has reiterated its position that the project, even in its reduced form, poses risks to the city's World Heritage status and should not proceed in its current format. Similarly, members of other opposition parties have called for a reconsideration of the entire development, expressing doubts about the project's future viability.
Civic groups and environmental organizations have also voiced criticism. Environmental advocates argue that the project presents significant challenges for urban conservation and sustainability, highlighting the importance of adhering to rigorous environmental standards in city planning.
The Heumarkt project has been the subject of extensive debate in Vienna for several years, with stakeholders including local authorities, international bodies, investors, and residents expressing a wide range of opinions.
