Neos Propose Mandatory Stay for Underage Offenders in Vienna

The Neos party in Vienna is advocating for the establishment of social educational facilities aimed at particularly troublesome minors, specifically those who are not yet of legal age. This initiative targets children aged between twelve and fourteen who have been involved in serious criminal activities such as severe bodily harm, robbery, or violence. The proposal includes the option for a temporary mandatory stay in these facilities if other measures prove insufficient to stabilize their behavior.

According to party representatives, the objective is not to isolate these children from society, but rather to provide them with essential support, structure, and professional guidance during critical phases of their development. The proposed facilities are envisioned as pedagogically and therapeutically supervised safe spaces, equipped with clear rules, structured environments, and tailored developmental support.

A mandatory stay would be considered a last resort aimed at interrupting extremely problematic behaviors in these minors. Such an action would require judicial approval, ensuring that the children have legal representation. The Neos assert that a federal legal framework is necessary for implementing this measure. They emphasize the importance of taking responsibility when young individuals engage in harmful behaviors towards others or themselves.

The proposed facilities would feature separate groups based on varying degrees of freedom, encompassing therapy rooms, educational spaces, workshops, common areas, sports facilities, and experiential educational activities. A multidisciplinary team consisting of educators, psychologists, therapists, teaching staff, and security personnel would staff these facilities.

Upon admission, minors would undergo different phases: a closed phase, a relaxed phase, and an open phase, with subsequent follow-up care. Through positive behavior and engagement in offered programs, youths would gradually gain more freedoms. The Neos highlight the need for transparent monitoring and documentation, ensuring that the legal recourse remains available at all times.

According to the party, the number of particularly problematic minors is small but significant. Due to their age, they cannot be held criminally accountable, yet they pose acute challenges to themselves and their surroundings. Existing legal and institutional frameworks are deemed inadequate to address these issues properly. The Neos specifically state that youths with severe psychiatric disorders or acute addiction issues should be excluded from this proposal, as they would fall under the medical care system.
