Delays Mark High-Profile Linz Corruption Trial with Schmid Testimony

Mon 9th Mar, 2026

The proceedings in a significant corruption case at the Linz Regional Court experienced notable delays, as former top official Thomas Schmid appeared as a key witness. The trial centers on allegations that three defendants facilitated the appointment of an ÖVP-affiliated mayor to a senior position at the Braunau tax office. The prosecution, led by the Economic and Corruption Prosecutor's Office (WKStA), bases its case partly on digital communications recovered from Schmid's mobile device. Schmid, who holds the status of a principal witness in the broader CASAG investigation--of which this case forms a part--would reportedly have faced charges himself without this cooperation.

Procedural Delays Over Recording Requests

On the day of the trial, Schmid arrived at the courthouse well in advance of the scheduled start and conferred privately with his legal counsel. However, the hearing was significantly delayed due to a series of procedural motions initiated by the defense. The presiding panel was required to repeatedly withdraw for deliberation, resulting in a substantial departure from the planned timetable.

One of the principal motions came from the defense attorney representing the accused parliamentarian, requesting that the entirety of the proceedings be recorded on both audio and video. The defense argued that the precision of the testimony required such measures. The court, however, denied this request, citing that audio recordings for transcriptional support were already in place and met procedural requirements.

Subsequent motions included a request for the defense to make its own recordings, which was also rejected. The panel referred to the court's house rules and criminal procedure code, which do not permit independent recordings, and noted that not all participants had consented to such measures. Following this, the defense requested the playback of previous audio records from the proceedings, a move that threatened to prolong the session by several hours or even days. This also prompted further deliberations by the court, compounding the already significant delay.

Allegations of Job Preferment

The core of the trial involves accusations that an ÖVP mayor sought assistance from a high-ranking parliamentarian, requesting a favorable recommendation for a position at the Braunau tax office. Both individuals acknowledge the communication, with the parliamentarian subsequently forwarding the applicant's documents to Thomas Schmid. Schmid is then alleged to have approached a member of the selection committee, seeking support for the mayor's candidacy.

Despite these actions, the parliamentarian has denied any intention to exert undue influence over the selection process. The committee member, who is also facing charges, confirmed that an attempt at intervention was made, but maintained that the mayor's qualifications were the decisive factor in the eventual favorable evaluation, rather than the external advocacy.

Legal and Political Implications

The case forms part of a broader investigation into alleged systemic corruption involving high-level officials and political figures. Schmid's testimony is considered pivotal, given his former position and insight into the internal workings of the public appointments process. The court's handling of the procedural motions underscores the complexity and sensitivity of the trial, as well as the heightened scrutiny of the proceedings by both legal observers and the wider public.

As the trial continues, attention remains focused on the unfolding testimonies and the potential implications for political accountability and transparency within the public sector.
