A St. Pölten waste collector has been sentenced to a conditional prison term following a serious threat made against a colleague. The incident arose amidst internal disciplinary issues, with both the accused and the victim currently suspended from their duties at the municipal department.
The case stemmed from allegations that waste was improperly disposed of for personal gain. The victim had previously reported the accused's actions to a supervisor during an internal investigation. In response, the accused confronted the victim, urging him to withhold information about the incident. When the victim confirmed he had already provided his testimony, the accused reacted with violent threats, stating he would 'break your face and kill you' if he lost his job as a result.
During the confrontation, the accused reportedly shoved the victim twice. Despite these serious allegations, the defendant maintained his innocence in court.
The victim described feeling extremely anxious and cautious in the days following the incident, indicating a significant emotional impact. In his defense, the accused argued that his choice of words reflected the 'living language culture' typical in his workplace. However, the presiding judge countered this claim, emphasizing the crucial distinction between casual workplace banter and violent threats made in a personal confrontation.
This was not the first time the accused had faced legal issues, as he had previous convictions dating back to 2010. The court ultimately found him guilty and imposed a conditional sentence of three months in prison.
