Reforming the Appointment Process to Enhance the Independence of the Ombudsman

Amnesty International has issued a call for the Austrian government to undertake a comprehensive reform of the appointment process for the Ombudsman, coinciding with the upcoming reappointment scheduled for June. This reform is seen as a critical opportunity to significantly bolster the independence of this important rights-protecting institution.

As outlined in the current government program, there are plans for mandatory parliamentary hearings and an evaluation of a new selection procedure. Amnesty International emphasizes that now is the ideal moment to turn these proposals into actionable reforms. According to the organization, the Ombudsman plays an essential role in safeguarding human rights in Austria. Consequently, there is a pressing need for a selection process that is open, transparent, and participatory.

The existing method for appointing Ombudsmen is perceived as heavily influenced by political parties, lacking both public announcement of positions and sufficient societal involvement. This situation presents a unique opportunity to restore public trust in this vital human rights institution.

Amnesty International urges the government to adhere to the recommendations set forth by the Subcommittee of the Global Alliance of National Human Rights Institutions (GANHRI). A key aspect of these recommendations is the establishment of a formalized appointment process that ensures the positions are widely advertised and includes extensive public consultation.

By implementing these changes, the government can affirm its commitment to human rights and enhance the credibility of the Ombudsman's office. The effectiveness of the Ombudsman in addressing and resolving rights-related issues hinges on its independence from political influences, making these reforms not just beneficial but essential for the protection of individual rights in Austria.
