Insovency Filed by 123 Shared Mobility GmbH in Lower Austria

123 Shared Mobility GmbH, based in Ternitz, Lower Austria, has filed for bankruptcy proceedings without self-administration at the Regional Court of Wiener Neustadt. The company, known for operating the 123-Transporter brand in Austria, has proposed a repayment plan to creditors offering a 20% repayment over two years.

The company has faced thousands of complaints at the Workers' Chamber (AK) regarding unauthorized deductions. In response to these allegations, the judiciary has initiated an investigation.

According to the company, it provided the IT infrastructure and platform technology necessary for car-sharing and rental services. A total of 419 transport vehicles used in Austria were supplied by a partner. The insolvency was attributed to the unexpected and contractually unlawful withdrawal of almost all vehicles from the system by this exclusive fleet partner, who deactivated them both systematically and physically. This action abruptly undermined the company's operational foundation in Austria, making vehicle rentals impossible.

The management of 123 Shared Mobility GmbH stated that they are actively working on future solutions, acknowledging that the current business model in Austria cannot continue in its existing form due to recent developments.

It is important to note that the operations in the Czech Republic, Slovakia, and Hungary remain unaffected. The company has clarified that these foreign markets operate independently and are unaffected by the situation in Austria.

In recent years, numerous individuals have reported issues to the AK, including deductions for security deposits or penalties for infractions such as speeding or smoking in vehicles. The public prosecutor's office in Wiener Neustadt is currently investigating the managing director of 123 Shared Mobility GmbH on charges of serious commercial fraud and embezzlement.
