E-Scooter Regulations: Police Empowered to Catch Speeding Riders

In a recent case that highlights the complexities of e-scooter regulations, law enforcement officials reported observing a rider traveling at 33 km/h on Brünner Straße, exceeding the legal speed limit for such vehicles. Under current Austrian law, e-scooters are classified differently depending on whether they are registered as small motorcycles, which carries distinct legal implications, including helmet requirements and licensing obligations.

The rider faced ten violations related to the Motor Vehicle and Driver's License Acts. Although the Administrative Court of Vienna annulled the penalties imposed by the Vienna State Police Directorate, it did so in a manner deemed procedurally flawed by the Administrative Court of Austria (VwGH).
